Intellectual Property Claim Procedure

1. Types of IP Claims We Address
This procedure applies to claims that a headwear product listing or design on our site infringes upon rights other than copyright:

2. How to Submit a Claim
If you believe a product on our Site infringes your IP rights, please provide our Agent with a written notice containing the following:

- Identification of IP: Registration numbers and links to official database entries (e.g., USPTO).
- Identification of Infringing Product: Direct URLs to the specific hat or cap listings.
- Basis for Claim: A detailed explanation of why the material is unauthorized.
- Good Faith Statement: A statement that you believe the use is not authorized by the law or the IP owner.
- Accuracy Statement: A statement under penalty of perjury that the info provided is accurate.
- Signature: Your physical or electronic signature.

4. Response & Counter-Notice
Upon receiving a valid claim, we will remove the allegedly infringing headwear listing and notify the seller. We aim to respond within 3-5 business days.
If you believe your hat listing was removed in error, you may submit a Counter-Notification including your contact info, the URL of the removed item, and a statement under penalty of perjury regarding the mistake.
5. Repeat Infringer Policy
Oceancitylove maintains a strict policy of terminating accounts of users who are repeat infringers (more than two valid IP claims). We reserve the right to suspend any account for egregious violations of headwear design rights.
6. False Claims
Submitting a knowingly false claim may expose you to liability for damages, including attorney's fees. If you are unsure if a hat design infringes your rights, please consult legal counsel before filing.
